Social Security Divorced Spouse Benefits: If you have never worked you may still be eligible for benefits based on your ex-spouse's work record. The rules regarding eligibility change over time but, generally, you qualify if: you marriage was 10 years or longer, you are unmarried, your ex-spouse is 62 or older, and your ex-spouse is entitled to Social Security retirement or disability benefits. If you would like to apply, you should look for Form SSA-2.

Before the Divorce is Final: Alimony is another way of describing spousal support -- this is money that one spouse pays to the other with the goal of maintaining the standard of living that was established during your marriage. Because there is no specific formula for alimony, our courts will consider the following: how long you were married, the reason(s) for the legal separation/divorce, the age and health of each spouse, the education of each spouse, and the amount and sources of income for each of you including your earning potential if you are under-employed.
After the Divorce/Post-Judgment Modification: If your divorce has been finalized your ability to modify alimony will depend on the language of the agreement. For example, if your agreement uses the phrase "non-modifiable," all or part of the alimony terms (how long and/or how much) may not be open to modification.
